Frankly, the Prop 8 decision bothers me both at philosophical and pragmatic levels. First of all, at a purely legal level, I have a lot of trouble with the notion that the 14th Amendment makes Prop 8 unconstitutional. Second, at a pragmatic level, given the current conservative make-up of the Supreme Court it seems very likely that this decision will be overturned. If the LGBT movement is going to get rid of Prop 8, it is going to probably need to focus on aspects other than a general 14th Amendment claim.
(Incidentally, how ridiculous backwards does the US seem when at this point there are countries in Europe, Asia, Africa and South America which recognize gay unions and the US still hasn't gotten its act together? Ugh.)
